Burnaby (City) v. Trans Mountain Pipeline ULC, concerns some of the machinations underlying the Burnaby pipeline project. In this particular case the City of Burnaby applied to the Courts, outside of the National Energy Board process already underway, for an injunction. The court took the position that the National Energy Board has jurisdiction and that Burnaby’s position amounted to a collateral attack on the NEB decision making process. Short version: Burnaby has to look for relief inside the NEB process.
